Difference Between the ICJ and the CERD Committee: A Comment on the Application of the International Convention on the Elimination of All Forms of Racial Discrimination (Qatar v. United Arab Emirates) Case

Abstract In the Qatar v. UAE case, the Court reached, without giving much explanation, an interpretation different from that of the CERD Committee over the phrase “national origin” in the International Convention on the Elimination of All Forms of Racial Discrimination. This, in fact, marks a deviation from the Court’s previous case law. Through a close reading of the Court’s judgment and the Committee’s decision, this comment argues that their diverging interpretations bring to the surface the structural differences between these two institutions. These differences had been obscured in the Court’s jurisprudence, and a more principled approach towards human rights treaty bodies is needed for the Court in the future.
