This study seeks to show that the Appeals Chamber of the ICC responsible for the ruling on the case of the armed conflict in Afghanistan has made an inchoate historic judgment. The analysis focuses on two main points: First, the reasoning made by the Prosecutor that the Pre-Trial Chamber abused its discretion in assessing the “interests of justice”; and second, the assessment of the scope of the procedural act. Finally, the unprecedented ruling of the ICC can consolidate the progressive positivism which now seems to be spreading across many areas of international law.
