The Australian News Media Bargaining Code: lessons for the UK, EU and beyond

ABSTRACT

In February 2021, following sustained brinkmanship from Google and Facebook, Australia passed into law its world-first 'News Media Bargaining Code' (Code), which seeks to address the bargaining imbalance between digital platforms and news media. Already, some have judged the Code to be a success, with other countries now considering implementing similar policy responses. In this analysis article, we highlight that while the Code is a largely welcome initiative, other jurisdictions need to be mindful of its weaknesses and the difficulties they are likely to encounter when attempting to secure passage of analogous legislation.
