Government of India, Department of Consumer Affairs through its Legal Metrology Division has floated a Stakeholder consultation on proposal for decriminalization of offence under Legal Metrology Act, 2009 (Act) and proposed to levy fines instead of imprisonment on the premises that Mens rea (malafide/criminal intent) is critical to evaluate the nature of non-compliance, i.e. fraud as compared to negligence or inadvertent omission (Govt of India, Ministry of Consumer Affairs, LM I-9/12/2020-W&M). This paper is an attempt to analyse the proposed decriminalization of the offences in the light of legal jurisprudence especially with reference to Strict Liability and Food Safety Standards Act 2006 with further reference to offence by Corporates.

印度通过其法定计量司消费者事务部的政府根据国际法制计量法，2009年（法案）漂浮在提案利益相关方咨询的罪行合法化，提出要征收罚款代替监禁的前提是犯罪意图（malafide /犯罪意图）对于评估不合规的性质至关重要，即与疏忽或无意遗漏相比的欺诈（印度政府，消费者事务部，LM I-9/12/2020-W&M）。本文试图根据法律判例，特别是参考 2006 年严格责任和食品安全标准法案，进一步参考企业犯罪，分析拟议的犯罪非刑事化。
