Abstract

Laboratory test reports are often used as one of the pieces of evidence needed in proving civil environmental justice cases. This study analyses court decisions and their ability to elaborate problems in transmitting these reports as scientific evidence in such cases in Indonesia. They can be qualified as written and expert testimony evidence, with their use left entirely to the judge's discretion. Furthermore, in judicial practices, judges' criteria in assessing these reports are formality and relevance. Conclusively, the research found that the report's relevance, which included validity and reliability, and support from expert testimonies, are critical points in their use as valid legal evidence with probative value in justice cases.

摘要

化验报告常被用作证明民事环境司法案件所需的证据之一。本研究分析了法院的判决及其详细说明在印度尼西亚此类案件中将这些报告作为科学证据传输时遇到的问题的能力。它们可以作为书面和专家证词证据，其使用完全由法官自行决定。此外，在司法实践中，法官评估这些报告的标准是形式性和相关性。最后，研究发现报告的相关性，包括有效性和可靠性，以及专家证词的支持，是将其用作具有司法案件证明价值的有效法律证据的关键点。
