Abstract

This article aims to open a dialogue on how laws and policies on internal displacement (should) address the issue of data. Despite a growing attention to law- and policy-making as well as data collection on internal displacement, and the amount of resources available on both areas, there seems to be very limited literature and guidance on which data provisions should be incorporated into internal displacement laws and policies and how, or what considerations should be kept in mind during this decision-making process. First, the article presents what international legal frameworks on internal displacement say about data, with a particular focus on the provisions on registration of internally displaced persons (IDPs) included in the Kampala Convention. Secondly, it offers a picture of the state of the art based on a review of the data provisions included in existing internal displacement laws and policies, highlighting key considerations for IDP law- and policy-making processes with regards to data and drawing some lessons learned from the implementation of data provisions in two country examples, Colombia and Georgia. The article concludes by putting forward some recommendations for data and legal experts and practitioners on internal displacement and calls for further research and analysis on this subject.
