The EU Trade Secrets Directive (Directive (EU) 2016/943 of the European Parliament and of the Council, OJ L 157/1) was adopted on 8 June 2016, and member states were required to comply with it by 9 June 2018. Before the directive some member states had fragmented laws with varying levels for protecting trade secrets across the EU. The directive aimed to harmonize the law on this matter. Some member states introduced new trade secrets laws in order to implement the directive whereas others implemented it by amending their existing legislation.

The book, edited by Schovsbo, Minssen and Riis primarily studies the national implementations of the directive in various member states and the issues that arose from implementing them. The authors, who include leading legal scholars, cover a wide range of specializations in the legal aspects of trade secrets protection and its impact on different segments of research and development, such as the information technology sector or collaborative research involving public research bodies.

Among the traits of the book are that it is written in clear and concise language and that the authors took the additional step of providing a basic background on EU law before discussing the details of the directive, which makes this book an important source for those who may not have an extensive knowledge of EU law relevant to the protection of trade secrets.

If we look at some of the specific chapters of the book, the chapter by Sandeen titled ‘Through the Looking Glass: Trade Secret Harmonization as a Reflection of US Law’ deserves a special mention. This chapter provides an in‐depth comparative analysis of the development of trade secrets protection in the USA and how it had been reflected in the EU harmonization process. The chapter is important because it shows that the European implementation of trade secrets protection has benefited from the US experience in terms of potential issues and overcoming them.

Udsen, Schovsbo and van der Donk's chapter looking at trade secrets law as part of information law is one that starts with great ambition and a promising perspective on the protection of trade secrets. However, the analysis on rights does not provide adequate insights on where in the theory of rights trade secrets law is located. The approach is enlightening and can shift the direction in which trade secrets law is perceived yet may need to be elaborated upon elsewhere within a framework of the theory of rights.

All in all, the book, with 15 chapters co‐authored by 18 contributors, fulfils an important task in providing a comprehensive context for the directive and effectively clarifies the reasons why the protection of trade secrets is – and must be – part of the EU harmonization agenda.

J. Schovsbo,T。
