espanolComo una alternativa a los enfoques teoricos juridicos normalmente utilizados —como los legalistas o formalistas— para el analisis de fenomenos sociales en investigaciones sociojuridicas, en este articulo se expondran los resultados de las reflexiones metodologicas y empiricas emanadas de una investigacion cualitativa previa, en la que el autor empleo como estrategia metodologica “la observacion en campo”, diferenciada de la generica “observacion participante”.En dicha investigacion se analizo el proceso de resistencia que lideraron tres organizaciones sociales que tienen su rango de accion en la periferia de la Comuna 8 de Medellin, por la reivindicacion del derecho a la ciudad y al territorio para esta poblacion, en medio de las obras que comprendieron la ejecucion de uno de los proyectos bandera de la administracion municipal de Anibal Gaviria (2012-2015): el Cinturon Verde Metropolitano - Jardin Circunvalar. A traves de este analisis se logro evidenciar una constante tension entre lo local y lo global, y un trabajo mancomunado entre organizaciones de base social para resistir a una concepcion hegemonica de la globalizacion y construir un derecho “desde abajo”. EnglishAs an alternative to the legal theoretical approaches normally used by legalists or formalists for the analysis of social phenomena in socio-legal research, in this article, the results of the methodological and empirical reflections emanating from a previous qualitative investigation will be presented, in the that the author used as a methodological strategy "field observation", differentiated from the generic "participant observation". In this investigation, the resistance process led by three social organizations that have their range of action on the periphery of the Commune 8 of Medellin was analyzed for the claim of the right to the city and the territory for this population, in the midst of the works that included the execution of one of the flagship projects of the municipal administration of Anibal Gaviria (2012-2015): the Metropolitan Green Belt - Circunvalar Garden. Through this analysis it was possible to demonstrate a constant tension between the local and the global and, a joint work between socially based organizations to resist a hegemonic conception of globalization and build a right “from below”.
