Kelly also underestimates the African nationalist reaction against the ICC’s indictment of President Omar Al Bashir of Sudan for the crime of genocide. This book deserved better editing. It appears to be a rather hasty compilation of several articles Kelly had previously published in legal journals. Complete sentences, long quotations, indeed entire paragraphs are repeated throughout, and later chapter content does not always seem to acknowledge the content of earlier chapters. The author’s choices of what to include in the appendices strike one as rather odd: for example, Canada’s law on Corporate Criminal Responsibility but not the CAHWCA. And there is no particular reason for a 14-page table of developments in civil law countries regarding corporate criminal liability to appear in the text. Despite shortcomings, however, this book is accessible to scholars of genocide who (like the reviewer) do not possess formal legal training. It is encouraging to learn that there may be a persuasive legal basis for prosecuting corporations for genocide, even if the prospects for the near future seem dim. Kelly’s findings should be discussed in future work on comparative genocide.
