Probation re-nationalisation…not quite

In May 2019, the Ministry of Justice announced its plans for further probation reforms in England and Wales, which will see the end of Community Rehabilitation Companies (CRCs) and the return of probation supervision (and the staff to carry out this role) to the National Probation Service (NPS). The government’s announcement was widely welcomed as newspaper headlines proclaimed the ‘re-nationalisation’ of probation, following the many documented failures of Transforming Rehabilitation (TR) reforms. However, it is clear that this narrative of re-nationalisation or a return to a previous state fall somewhat short of mark, as the detail of what the government plans to ‘strengthen probation’ and build public confidence have been further elaborated. The outline of what the government plans to do is set out in its response to the Strengthening Probation Consultation (MoJ, 2019) and in the Proposed Future Model for Probation (HMPPS, 2019). It is clear from these plans that the marketised model that was a driving rationale for Transforming Rehabilitation is not to be dispensed with, but rather reformulated. The government outlines that while the NPS will have responsibility for supervising people subject to community orders and on licence, it will also be obliged to commission services such as unpaid work, accredited programmes, and ‘wider resettlement and rehabilitation interventions’, from the market. Twelve NPS regions will replace the current structure of 21 CRCs and 7 NPS geographical divisions. Each NPS region will have an ‘Innovation Partner’ from the private or voluntary sector and they will be obliged to contract them to carry out this work:
