The ILO Tribunal’s Statute requires that staff members must exhaust available means of redress in order for their complaints to be received by the ILO Tribunal. In recent decisions, the ILO Tribunal has addressed the problem of internal appeals boards not being constituted in accordance with the international organization’s internal rules (by, for example, the relevant staff association failing to appoint appeals boards’ members) and the effect this failure has on the ILO Tribunal’s competence to hear a claim. This piece addresses the ILO Tribunal’s approach to such situations.
