Over the years since the Treaty establishing the European Economic Community came into force, the EU Courts have regularly been called upon to engage with the ‘dichotomy between restriction of competition by object and restriction by effect’1 set out in what is now Article 101 of the Treaty on the Functioning of the European Union (TFEU).
