The concern not to omit something that others have already said, or the fear of not giving enough account of the existing bibliography should never override scholarly coherence and originality. This is precisely the difference between the academic exercise performed by a student and the autonomous research conducted by a scholar. Elsewhere, it is the author’s lack of experience in handling legal categories that leads her to refer to papers dealing with problems which are at best on the margins, if not completely outside her own subject, as for example the maxim ‘no one should ignore the law’ in the writings of K. Weidenfeld (126). The problems raised by the use of research done by others are compounded, in the case of Maud Ternon, by the problem arising from her ignorance of both sources and works concerning other legal fields than that of her main theme. Thus, she reduces the medieval trial to its sole customary expression (32–33) and mixes up testimony, fama and notoriety (58–59). Thus, when speaking of guardianship and curatorship, she also fails to point out the Church’s duty of assistance to the persons in need (107–108). In short, this book will inevitably leave medieval legal historians hungry but will, on the other hand, strengthen medieval social historians in their analysis of legal and judicial phenomena. However, the book may also be useful to both groups of scholars, because it makes it possible to understand the crystallisation of customary law, of which historians sometimes have an outdated vision, and the application of family strategies, the importance of which lawyers too often neglect. But it will be especially enjoyable for non-specialists in both fields, who will find all the ingredients to satisfy their taste for medieval studies.
