Addressing excessive pricing concerns in time of the COVID-19 pandemic—a view from South Africa

I . I N T R O D U C T I O N In South Africa, like in many other countries around the world, the COVID-19 pandemic is first and foremost a public health crisis. To address the public health crisis, government has taken extraordinary measures to curb the spread of infections, including requiring people quarantine at home and non-essential businesses to close. On 15 March 2020, South Africa declared the COVID-19 pandemic a national disaster in terms of the Disaster Management Act No 57 of 2002 (as amended). As part of a broader response to the COVID-19 pandemic, on 19 March 2020, the Minister of Trade and Industry published Consumer and Customer Protection Regulations and National Disaster Management Regulations and Directions, which establish factors for assessing excessive pricing cases during the national disaster period. These regulations respond to the COVID-19 pandemic panic buying increase in demand and the corresponding spike in prices, for particular goods and services.
