Abstract:The doctrine of tenure is an unquestioned principle of the common law of real property. In this article, I examine the way in which the doctrine of tenure (or, as I call it, Crown tenure) has been used to displace Indigenous property rights and to undermine Indigenous assertions of sovereignty.
