The Transnational Investment Process from the Perspective of the New Haven School of Jurisprudence

Abstract The legal famework governing the transnational investment process may be characterised as being fragmented and loosely governed by bilateral or regional investment treaties, with the result that foreign investors receive unsatisfactory protection and host States fear that their regulatory competence will be challenged. This article attempts to illustrate the utility of the New Haven School offurisprudence in the study of the transnational investment process by applying a functional analysis to elaborate on some of the salient features of that process.
